By downloading or using software of Symmetricom, Inc., or its subsidiaries ("Symmetricom"), you agree to the following terms and conditions. If you do not agree with such terms and conditions, do not use the software. The terms of Symmetricom's Software License Agreement and Software Maintenance Agreement (if purchased) which accompany the original or new versions of the software and patches, point releases, maintenance releases, updates, enhancements, or upgrades thereto upon installation or download, are applicable in addition to the terms and conditions stated below.

Export Law Assurances
The export and re-export of Symmetricom's telecommunications products software is controlled by the United States Export Administration Regulations and such software may not be exported or re-exported to Cuba, Iran, Iraq, Libya, North Korea, Sudan, or Syria or any country to which the United States embargoes goods. In addition, Symmetricom software may not be distributed to persons on the Table of Denial Orders, the Entity List, or the List of Specially Designated Nationals.

By downloading or using a Symmetricom software product, you acknowledge that the software and documentation, and the products they are used in conjunction with, are subject to U.S. and other countries' export and import laws and regulations and agree to comply strictly with all such laws and regulations. You certify that you will NOT transfer or export, directly or indirectly, any software or documentation, or any portions thereof, including without limitation any technical data, related materials, or updates, into any country or to any entity prohibited under the above-referenced Export Regulations, as amended, or in violation of any other applicable law, nor use them in any manner or for any purpose prohibited by such regulations or in violation of any other applicable law.

Confidentiality
You acknowledge that the software and documentation are confidential and proprietary information and contain trade secrets of Symmetricom or its licensors and agree to hold all such information in strictest confidence. You may not use or disclose to any third party any such information except as expressly permitted under the terms and conditions of the Software License Agreement or a contract with your company.

Extension of Limitations of Warranty and Liability
The limitations of warranty and liability contained in the Software License Agreement extend to all updates, upgrades, enhancements and new versions of the software.
